1. Purpose of the UGC page

This page sets out the rules for user-generated content (hereinafter referred to as "user-generated content"). « UGC ») in connection with the use of the TrustWeb site, comparison of online web agencies available athttps://trust-web.be/. These include notices, notes, comments, texts, images, screenshots, logos, videos, links and, more generally, any content you publish or transmit via the platform. By posting content on TrustWeb or sending it to TrustWeb, you declare that you have read and accepted these UGC terms and conditions without reservation, in addition to the legal notice and the general conditions of use of the site.

3. Types of content concerned (UGC)

Among other things, the content generated by users is considered to be: – The opinions, notes and comments published on the agency cards. – Evidence, feedback, recommendations and case studies. – Images, logos, screenshots or visuals provided by users. – Texts or messages published in the interactive areas of the site (forms, sections) « Opinion », etc.). – Links to external content inserted by users.
 

4. Rules for publishing content

To be published or stored on TrustWeb, your content must comply with the following rules: – Do not be contrary to applicable laws and regulations, notably Belgian and European. – Do not be defamatory, abusive, obscene, hateful, discriminatory, violent or inciting violence or harassment. – Do not contain racist, xenophobic, homophobic, sexist or discriminatory statements against a person or group. – Do not infringe the intellectual property rights of third parties (copyright, trademark, design, software, etc.). – Do not infringe the right to image or privacy of third parties, especially minors. – Do not contain viruses, malicious code or link to dangerous sites. – Do not constitute a hidden advertisement or a massive spam. TrustWeb reserves the right to decide unilaterally whether content complies with these rules and may refuse to publish or delete it at any time, without notice, in case of non-compliance.
 

5. Your guarantees as a user

By publishing a UGC on TrustWeb, you declare and guarantee that: – You are the author of the content or have all the rights and authorizations necessary to publish it. – Potentially identifiable people (clients, collaborators, models, etc.) have given their consent to the dissemination of their image or data. – Your opinion or testimony is sincere, true to your actual experience with the agency concerned and is not based on manifestly false information. – Your content does not violate any third party rights or any applicable legal or regulatory provisions. You remain responsible for the content you publish on TrustWeb and the consequences that may result.
 

6. Licence granted to TrustWeb

By submitting a UGC on the site, you grant Trust Web: – A non-exclusive, global, free license for the legal term of rights protection, allowing you to reproduce, represent, adapt, translate and broadcast your content on the TrustWeb site. – The right to use your content, in whole or in part, as part of the promotion of the platform (examples of opinions, extracts from testimonies, etc.), on any digital medium controlled by Trust Web (website, newsletters, social networks, etc.), while respecting your privacy rights. This license does not entail the assignment of your intellectual property rights: you remain the owner of your content, subject to the above license.
 

7. Moderation and deletion of content

TrustWeb implements a posteriori or a priori moderation of content, as appropriate. As such, TrustWeb may, in its sole opinion: – Refuse to publish content that does not comply with the rules of this page or the legal notices. – Delete, hide or modify content that is manifestly unlawful, misleading, obsolete or inappropriate for the context of the site. – Suspend or close a user's account in case of serious or repeated breaches. TrustWeb cannot guarantee instant moderation, but undertakes to act within a reasonable time after reporting problematic content.
 

8. Request to withdraw or report content

If you wish: – Remove content that you have published yourself; – Report content that you consider illegal or infringing your rights; you can: – Use, when available, the removal or alert feature on the relevant page. – Contact TrustWeb via the contact form of the site or by e-mail atcontact@trust-web.be, indicating the URL of the page, the content description and the specific reason for the alert. TrustWeb may ask for additional information to verify your identity and/or interest in acting, and will decide whether to delete or maintain the content within a reasonable time.
 

9. Personal data and UGC

The publication of content may lead to the collection and processing of certain personal data (name, first name, pseudo, profile photo, historical opinions, etc.). These processings are carried out by Trust Web in accordance with the General Data Protection Regulation (GDPR) and the Belgian law of 30 July 2018, as described in the section « Personal data management » legacies
